TERMS OF SERVICE

Welcome to the website and services of Supreme Septic Pumping & Inspections LLC, doing business as A&K Pumping ("we," "us," or "our"). By booking a service, accessing our website, or communicating with us, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Services Provided
A&K Pumping provides septic system maintenance, pumping, Title V inspections, and minor repair services.
Scope: We perform the specific services requested by the customer (e.g., "1,000-gallon pump-out"). Any additional issues discovered during service (e.g., broken baffles, root intrusion) will be quoted separately.
Emergency Service: Emergency or after-hours service is available but subject to additional "Emergency Dispatch Fees" which will be disclosed prior to dispatch.
2. Pricing & Payments
Estimates: All phone or online quotes are estimates based on standard conditions (e.g., tank lids exposed or easily accessible). Final pricing may change based on actual site conditions.
Digging Fees: A standard pump-out assumes the tank cover is exposed or within 6 inches of the surface. If digging is required to access the cover, a Dig Fee ($100 - $150 minimum) will apply.
Payment Terms: Payment is due upon completion of service. We accept cash, check, and major credit cards. Late payments may be subject to interest charges of 1.5% per month.
3. Customer Responsibilities
To ensure safe and efficient service, the Customer agrees to:
Access: Provide clear access for our pump truck (within 100 feet of the tank). We are not responsible for damage to driveways, lawns, or irrigation systems caused by the weight of our trucks if instructed to leave the pavement.
Location: Accurately identify the location of the septic tank covers. If the location is unknown, a "Locating Fee" may be charged for time spent finding the tank.
Obstructions: Ensure the area over the tank is free of heavy objects, decks, or locked gates.
4. Liability & Disclaimers
Property Damage: While we take great care, A&K Pumping is not liable for minor lawn damage, settling of dirt, or damage to underground utilities (sprinklers, invisible fences) that were not clearly marked by the homeowner prior to digging.
System Failure: Pumping a tank is a maintenance service, not a cure for a failed leach field. We do not guarantee that pumping will fix a system that is already in failure, blocked, or hydraulically overloaded.
AI Communications: Our website and phone lines may use Artificial Intelligence (AI) to assist with scheduling and basic questions. A&K Pumping is not liable for unintentional errors made by automated systems. All critical service details will be confirmed by a human technician.
5. Cancellations & Rescheduling
Notice: We request at least 24 hours' notice for cancellations.
Missed Appointments: If we arrive at the scheduled time and cannot access the property or tank (e.g., locked gate, aggressive dog), a "Trip Charge" of $75 may be billed.
6. Title V Inspections
Outcome: A Title V Inspection is an assessment of the system's condition at the time of inspection. A "Pass" does not guarantee future performance or longevity of the system.
State Reporting: By law, inspection results must be filed with the local Board of Health.
7. SMS/Mobile Messaging Terms & Conditions
By providing your phone number to A&K Pumping, you agree to receive recurring automated marketing and informational text (e.g., SMS and MMS) messages from us.
Program Description: We send text messages to provide appointment confirmations, service reminders, estimates, and occasional promotional offers regarding our septic services.
Message Frequency: Message frequency will vary. You may receive multiple messages during an active service booking.
Cost: Message and data rates may apply to all messages sent and received.
Carrier Liability: Carriers are not liable for delayed or undelivered messages.
Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to the short code or number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

8. Age Restriction
Our services and this website are not intended for individuals under the age of 18. By using our services or agreeing to these Terms, you represent and warrant that you are at least 18 years of age.
9. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising from these Terms shall be resolved in the courts of Barnstable County.
